A durable Power of Attorney is more flexible than a Guardianship. A Guardianship is court supervised, is court controlled, and there are very specific statutes and responsibilities for a guardian. Recent changes in the Guardianship code make it more difficult for a guardian to interact with the court and with the family; and solve all of the problems of the senior adult. We prefer a use of a durable Power of Attorney.
