These so-called pocket deeds are legally effective to pass title only if there’s been a delivery of them, notwithstanding the fact that they are unrecorded. There are a number of problems that can arise under the Marketable Title Act as a result of this. We recommend instead consideration of a life estate deed or a ladybird deed. Usually, pocket deeds are not a good idea.
