Does all personal property and real property have to go through an estate when a person dies?

No it does not. Probate covers what’s in your name alone without a beneficiary designation. For example if your home is already subject to a Lady Bird deed, that particular property would not go through probate. Your automobile may be excepted from probate by the tag agency in dealing with your spouse, or in dealing with your children. Check with a knowledgeable elder law attorney who can advise you on these matters.
