A durable power of attorney is a way to appoint someone informally, but in writing, as your agent. This is often a substitute for guardianship. That person does become your fiduciary and has responsibilities under the instrument and under the Florida statutes. It is an important position of trust. You should not grant someone a durable power of attorney lightly. They should be very trustworthy and close to your situation.
